Terms of use

LandSearch, LLC ("LandSearch," "we," "us," or "our") appreciates your engagement with our Marketplace and/or related services (collectively known as the "Services," or, each individually, a "Service"). By using our Services, you agree to be bound by these Terms.

Summary

  • You can use the Services for personal use or authorized professional activities. Verify all published information.
  • When you post listings or profiles, you give us permission to modify, display, and distribute them.
  • You're responsible for providing accurate and complete information in all listings, profiles, and communications.
  • We charge for certain services. Failure to pay may result in additional fees or account termination.
  • LandSearch is affiliated with a real estate brokerage that may refer you to agents and receive compensation from resulting transactions.
  • We provide the service "as is" without warranties of any kind. You release LandSearch from all liability.

Permissable use

Unless you're an industry professional acting in a professional capacity, you agree to only use the Services for your personal use. Your commercial use is limited to transactions done on your own behalf.

For real estate, lending, and service professionals, commercial use is limited to:

  • Providing information to consumers via the Services
  • Where authorized, taking actions on behalf of a client (e.g., posting a property for sale or inquiring as a buyer's agent)

What you can do:

  • Copy information from the Services as necessary for personal use
  • View, save, print, and/or email such information for personal use

What you cannot do:

  • Reproduce, modify, distribute, or create derivative works from our content
  • Provide unauthorized access to our Services to others
  • Decompile, disassemble, or reverse engineer any portion of the Services

Example: You can save property photos to show your spouse, but you cannot repost those photos on another website without permission.

Restrictions and additional terms

Acceptable use

You agree not to:

  • Use the Services in any way that is unlawful or harmful to LandSearch or other users
  • Distribute or post spam or other malicious content
  • Impersonate another person or misrepresent your affiliations
  • Use the Services for resale or similar purposes

Email notifications preferences

You may manage your email notification preferences through your account settings or by using unsubscribe links provided in our emails.

If you mark our emails as spam or junk with your email provider instead of unsubscribing through proper channels, we may suspend all email notifications to your account to maintain our email deliverability and sender reputation. This suspension will remain in effect until you update the settings from your account.

Automated queries

Automated queries are strictly prohibited unless you have received our express written permission. This includes:

  • Screen and database scraping
  • Spiders, robots, and crawlers
  • Any automated activity to extract information

Limited Exception: Public search engines and large language models may index our website in accordance with fair use principles.

Fees and billing

LandSearch reserves the right to:

  • Institute charges for any services
  • Downgrade accounts with past-due payments
  • Terminate subscribers for Terms violations or fraudulent activity
  • Change pricing at any time, with 30 days' notice before any price increase affects recurring subscribers

Billing terms:

  • Multiple agents/users cannot share a single account
  • Payments are either prepaid or automatically charged as specified
  • Late payments may incur 5% monthly interest
  • Services may be suspended after 7 days past due
  • Removal from the Marketplace may occur after 30 days past due
  • Early termination may result in 50% charge of remaining contract value
  • Subscriptions auto-renew unless cancelled before renewal date

Subscriptions can be cancelled by contacting us or visiting the billing portal linked in your subscription receipts. After the current billing period ends, any promoted listings are demoted but remain displayed unless marked as inactive or sold.

Listing credits

Basic listing credits work as follows:

  • One credit = initial post, updates, and ongoing display
  • Credits are consumed when a unique listing is posted
  • Syndicated listing must have a unique listing key
  • Listings initially posted with a promotion don't require a separate credit
  • Credits never expire, unless contracted otherwise

Example: If you purchase 50 listing credits, you can post up to 50 different properties. Updating those listings doesn't consume additional credits, but posting a 51st property would require an additional credit.

Refund policy

All subscription fees are non-refundable unless contractually stated otherwise. If you fail to cancel your subscription before the automatic renewal date, you will be charged for the subsequent billing period and no refund will be provided.

It is your responsibility to cancel subscriptions in advance of renewal if you do not wish to continue service.

Content and submissions

Data licensing

When you post content to LandSearch, you grant us a perpetual, royalty-free license to modify, display, and distribute that content to operate our Services.

  • Use, copy, distribute, and display your content
  • Edit, modify, and create derivative works
  • Use your content to operate, market, and promote our Services

Once a listing has been published on our Marketplace, it cannot be deleted by the user. Published listings become part of our permanent database for historical records, market analysis, and platform operations. You may mark listings as inactive or sold, but the listing data will remain in our system indefinitely.

We may modify your Submissions through automated or manual processes to improve:

  • Accuracy
  • Readability
  • Grammatical correctness
  • Compliance with policies
  • Overall content presentation

We may choose which version of a listing or profile to display if we receive it from multiple sources, prioritizing accuracy and quality. Submission may also be merged, incorporating data from multiple sources.

Maintaining accurate listing information, contact methods, and status is required. Failure to do so may result in account restrictions or termination.

Listing augmentation

To improve the quality and completeness of listings on our Marketplace, LandSearch reserves the right to supplement user-submitted listings with additional relevant information from public records, third-party data sources, and AI-generated content.

This may include, but is not limited to:

  • Property details (lot size, year built, zoning)
  • Listing types and tags
  • School district information
  • Nearby amenities and points of interest
  • Property tax information
  • Market comparisons and historical pricing data

We make reasonable efforts to ensure accuracy of supplemental information, but users should verify all listing details.

By posting, you consent to our enhancement of your listings with supplemental information. If you find inaccuracies in the data, contact us for assistance.

Representations and warranties

For each Submission, you confirm that:

  • The information is accurate and complete
  • You have the legal rights to provide and license this content
  • The content doesn't violate anyone's intellectual property rights
  • Listings follow all applicable real estate laws and regulations
  • You will not alter the listing to represent different underlying real estate

Guidelines and best practices

For maximum listing effectiveness:

  • Upload high-quality, landscape-oriented photos
  • Provide complete and helpful property descriptions
  • Include detailed property information (taxes, utilities, zoning)
  • Set realistic pricing based on market conditions
  • Update listings when information changes

Enhance your profile presence by:

  • Completing all profile fields
  • Using a professional headshot
  • Highlighting your expertise and credentials
  • Keeping your service area information accurate
  • Including your website and social media profiles

Account responsibility

You are solely responsible for:

  • All content submitted through your account
  • Keeping your account secure
  • All actions taken through your account

Each individual user is permitted only one account. Creating multiple accounts is strictly prohibited and may result in immediate termination of all associated accounts.

Technical limitations

You agree not to:

  • Interfere with the proper functioning of our Marketplace
  • Create unreasonable load on our servers
  • Attempt to access restricted areas of the platform

Submission review

We welcome all submissions that adhere to our posted guidelines. Submissions that don't follow these guidelines may be rejected, and we'll communicate specific issues for resolution when possible. After multiple policy violations, your posting privileges may be permanently restricted.

We reserve the right to refuse any submission at our sole discretion. While we aim for transparency, we may decline submissions without providing advance notice or explanation in certain circumstances.

Published listing and profile edits that violate our policies are subject to modification or removal at our discretion. We may edit content to bring it into compliance with our standards, or we may unpublish listings or profiles that cannot be adequately corrected. Users will not receive compensation for content that is modified or removed due to policy violations.

Marketplace operation

LandSearch connects buyers, sellers, and professionals in the real estate market. We are not:

  • A buyer or seller of property
  • A negotiator for real estate transactions
  • A property leasing service

We operate the Marketplace, but do not actively participate in transactions.

  • We don't verify or guarantee listing accuracy
  • All listings are the responsibility of the posting party
  • Buyers should perform their own due diligence
  • We're not liable for inaccurate listings
  • Services are provided "as is" without warranties

Affiliation and referrals

LandSearch, LLC is affiliated with LandSearch Real Estate, Inc., which operates as a licensed real estate brokerage in one or more states. For current licensing information, including license numbers and jurisdictions, view our licenses.

When you submit an inquiry through our Services, you consent to being contacted by LandSearch, its affiliates, and matched real estate professionals via email, phone, and text message regarding your inquiry. This contact may involve the use of automated mechanisms, including prerecorded and artificial voice messages.

When you use our Services, LandSearch Real Estate, Inc. may make referrals to third-party real estate agents or professionals, which may include sharing your contact information with those parties. We may also share information about your recent and future site activity with matched real estate professionals, including properties you've viewed, saved, or inquired about. This allows them to better understand your needs and provide more personalized assistance.

Real estate transactions that result from these referrals may generate compensation for LandSearch Real Estate, Inc. By using our Services, you acknowledge and consent to this referral process and the potential sharing of your contact information for referral purposes.

LandSearch may follow up on listing and profile inquiries to ensure users have been satisfactorily assisted. During this follow-up process, we may provide you with options or suggestions to connect with a referred agent for ongoing assistance with your real estate needs.

LandSearch does not endorse or guarantee the services of any professionals available through our Marketplace. All professionals operate independently, and you are responsible for conducting your own due diligence when choosing who to work with.

Messaging

Without altering intent, we may modify submitted messages through automated or manual processes to improve:

  • Accuracy
  • Readability
  • Grammatical correctness
  • Compliance with policies

When you send messages through our platform, you agree to:

  • Maintain professional communication standards
  • Respond promptly and courteously to responses you receive
  • Engage in good faith with other users

Messages that violate our posted guidelines may be rejected or, in severe or repeated cases, result in permanent restrictions to your messaging privileges. Messages that require manual review may be subject to delivery delays.

We strive for transparency, but reserve the right to reject messages or restrict senders at our sole discretion without advance notice or explanation.

Guidelines and best practices

When engaging with prospects:

  • Be professional and courteous
  • Respond as quickly as possible
  • Provide clear, specific information

Failure to respond or engaging in unprofessional communication may result in removal from the Marketplace.

If you mark emails from LandSearch as spam or junk with your email provider, we reserve the right to unpublish your active listings and restrict your ability to post new listings. These restrictions help us maintain our email deliverability and platform integrity. You may contact us to restore your listing privileges.

Loans

LandSearch is not:

  • A lender or loan originator
  • A loan processor or underwriter
  • A provider of credit applications
  • A pre-approval service

When you request loan information through our Marketplace:

  • This is not a formal loan application
  • We don't endorse specific lenders or products
  • We don't guarantee loan terms or approval
  • We're not your agent in the loan process
  • We merely connect consumers with potential lenders

Consumers must use their own judgment when evaluating loan options.

Participating lenders

Lenders on our Marketplace:

  • Are solely responsible for their services
  • Make their own decisions about contacting you
  • Operate independently from LandSearch

We are not liable for lender actions or errors in the loan process, and we may remove lenders from our Marketplace at any time.

Advertising

Promotion

Our search and display algorithms:

  • Use multiple factors to determine result relevance
  • Give additional visibility to promoted listings
  • Sort results using proprietary methods that may change
  • Consider factors like listing completeness, quality, and recency

Promotion listing benefits include:

  • Increased exposure in relevant property searches
  • Featured placement on similar basic listings and throughout the site
  • More exposure in email updates
  • Eligibility for distribution on social media
  • Distraction-free listings with the seller’s other listings displayed

You agree not to:

  • Demote promoted, active listings to post another with the promotion
  • Post listings for the same organization using multiple accounts that aren't members of the same team

For licensed real estate agents we offer enhanced visibility in up to 5 counties of your choice, which include:

  • Increased exposure in the professional directory
  • Featured placement in relevant property searches
  • Featured placement on relevant basic listings
  • Featured placement in relevant email updates

Display advertising

Our advertising services offer targeting by:

  • Property characteristics (location, price, size, tags)
  • User location
  • Other relevant attributes

By providing advertising materials, you give us permission to modify, display, and distribute them in connection with your advertising campaign.

We reserve the right to refuse or discontinue any advertisement, issuing a prorated refund.

Third-party resources and participants

When engaging with third-party resources or Marketplace participants:

  • We don't endorse or take responsibility for external content
  • Our Terms don't apply once you leave our site
  • Your interactions with third parties are between you and them
  • We're not responsible for issues with third-party services
  • Third-party content we display is subject to their terms

Claims of copyright infringement

LandSearch complies with the Digital Millennium Copyright Act. If you believe content on our Marketplace infringes your copyright, contact us with the following:

  • Description of your copyrighted work
  • Location of the allegedly infringing content
  • Statements of good faith belief in infringement and accuracy
  • Your contact information

We will respond to legitimate notices by removing or disabling access to the content. Users may submit counter-notices if they believe content was wrongfully removed.

Intellectual property

  • The Services are owned by LandSearch and protected by intellectual property laws
  • Our trademarks include LandSearch, LandSearch.com, and the pin marker design logo
  • We don't claim copyright over user-submitted real estate listings

Limited liability

We are not liable for damages resulting from your use of our services, including:

  • Indirect or consequential damages
  • Special or incidental damages
  • Damages from breach of contract or warranty
  • Damages from negligence
  • Any other damages, even if we're warned they might occur

Your Only Remedy: If you don't agree with these terms or have a dispute with us, your only option is to stop using the Services.

Industry compliance

Real estate regulations

LandSearch respects applicable real estate laws, including:

  • State licensing requirements for real estate activities
  • Fair Housing Act prohibitions against discrimination
  • Real Estate Settlement Procedures Act (RESPA) provisions
  • State-specific disclosure requirements

Fair housing

All users must comply with all applicable Fair Housing laws, including but not limited to the federal Fair Housing Act, which prohibits discrimination based on race, color, religion, sex, handicap, familial status, or national origin. Many states and localities provide additional protections based on attributes such as sexual orientation, gender identity, source of income, age, marital status, and veteran/military status.

Users are responsible for understanding and complying with all fair housing requirements in their jurisdiction. Any listings or communications that violate applicable fair housing laws may be removed, and repeated violations may result in account termination.

Licensing requirements

Real estate professionals must:

  • Hold valid licenses for jurisdictions where they practice
  • Provide license information when requested
  • Follow applicable advertising regulations
  • Make required disclosures

ADA compliance

We strive to make our Services accessible to users with disabilities and encourage listing providers to include accessibility information in property descriptions.

Account termination

User-initiated termination

You may terminate your account by contacting us after completing the following:

  • Completing any outstanding contractual obligations
  • Cancelling any paid subscriptions

After termination:

  • Active listings will be removed from public display
  • Your profile will no longer be visible
  • You'll no longer have access to saved favorites or searches
  • Listing data may be retained indefinitely for historical records, market analysis, analytical purposes, and platform operations
  • Personal information will be deleted according to our Privacy Policy and applicable data protection laws, except as required for legal compliance or dispute resolution

LandSearch-initiated termination

We may terminate or suspend your account for:

  • Violation of these Terms
  • Extended periods of inactivity
  • Fraudulent activity
  • Non-payment of fees
  • Any other reason at our discretion

While we may attempt to notify you via your registered email address, we are under no obligation to provide advance warning or explanation for account termination.

Data protection and security

Security measures

We implement reasonable technical and organizational measures to protect your data, including:

  • Encryption of sensitive information
  • Access controls and authentication
  • Regular security assessments
  • Secure data storage practices
  • Monitoring for suspicious activities

Data handling practices

We handle your data according to our Privacy Policy and applicable laws. Key practices include:

  • Limiting data collection to what's necessary
  • Restricting access to authorized personnel
  • Retaining data only as long as needed
  • Secure deletion practices
  • Prompt response to security incidents

User responsibilities

You share responsibility for security by:

  • Using strong, unique passwords
  • Not sharing account credentials
  • Logging out from shared devices
  • Promptly reporting suspicious activities
  • Keeping your contact information current

General

Additional rules and requirements

Additional rules, requirements, and guidelines may be communicated contextually throughout different areas of the Marketplace. Those additional terms are incorporated by reference into these Terms and are equally binding.

Pay attention to notices, tooltips, help sections, and instructional content that appears in various parts of our Marketplace.

Confidentiality

Both parties must keep confidential:

  • User data
  • Pricing information
  • Marketplace analytics
  • Business strategies

This obligation continues even after you stop using our Services.

Relationship of parties

Our relationship is not a:

  • Partnership
  • Joint venture
  • Franchise
  • Agency
  • Exclusive arrangement

Severability

If part of these Terms is invalid, the rest remains in effect.

Assignment

  • We can assign this agreement anytime
  • You can assign your rights with 30 days' notice to us
  • This agreement binds successors and assigns

No waiver

If we don't enforce a provision, we can still enforce it later.

No warranty

We provide our services "as is" without warranties. This means:

  • We don't guarantee the quality or performance of the services
  • We don't promise the information will be accurate or error-free
  • We don't warrant that the service will be uninterrupted
  • We don't provide any implied warranties of merchantability or fitness
  • We don't guarantee that using our service won't infringe others' rights

We make no guarantees, warranties, or representations regarding:

  • Lead generation or conversion rates
  • Marketing effectiveness of listings or profiles
  • Response rates to inquiries or messages
  • Any specific business outcomes from using our Services

In Simple Terms: While we strive to provide a quality service, we can't make legal promises about how well it will work for your specific needs.

Dispute resolution

Any dispute related to these Terms will be resolved as follows:

  • Informal Resolution: 30-day negotiation period
  • Binding Arbitration: Unresolved disputes will be settled by binding arbitration in El Paso County, Colorado, administered by the American Arbitration Association
  • Individual Claims Only: All claims must be brought individually, not as part of a class action
  • Small Claims Exception: Either party may bring individual claims in small claims court

The winning party in any legal action can recover reasonable attorney's fees.

Indemnification

You agree to protect LandSearch from claims arising from:

  • Your breach of these Terms
  • Your use of the Services
  • Your violation of laws or others' rights
  • Content you submit to the Marketplace

This means paying for our defense costs, damages, and related expenses.

Release

You release LandSearch from liability for claims against third parties related to the Services.

California Residents: You waive California Civil Code Section 1542, which would otherwise limit this release to known claims.

Changes to these terms

We may change these Terms at any time. The "Last updated" date will reflect the most recent change. Your continued use after changes means you accept the new terms. You should review these Terms regularly.

Definitions

  • Listing Data: All property information, images, descriptions, specifications, prices, availability, and other content displayed on the Marketplace, including any updates or modifications thereto.
  • Marketplace: The LandSearch online platform, including its website and other channels.
